Last i knew if i bought a gun/rifle from a LA resident i did not have to register it, a few years ago i bought a 7 mag from a local lady, i called the sheriff office and asked if there was some sort of transfer we ( the seller and buyer )needed to do . i.e. apply for registration, i was told no, a simple signed bill of sale in between the 2 parties was enough, now i'm on the atf site and read this article below, did i miss something ?

I'd say the fly in the ointment is the barrel lenght of the rifle. Under 16 inches is considered an SBR (short barreled rifle) and requires a stamp, same as with suppressors.

thats not a new law. His gun was not a legal gun for him to own. A shoulder fired rifle barrel can be no shorter than 16' without the rifle being registered to someone certified to own a such type weapon. Would be the same as someone without a class III owning a fully auto. Regular firearms without any special designation require absolutely nothing to sell or trade second hand privately. Not even a hand shake is required.

A person has to have an actual permit to carry a rifle with a barrel shorter than 16'

Right, unless your gun is some sort of restricted firearm like a fully automatic weapon or something there is no such things as registering them. It is illegal for the Federal gov't to keep a database/registry.

YOU CAN'T REGISTER non restricted firearms including handguna.

He did not have a tax stamp for the rifle. ie.SBR. Anything shorter than 18 inches for a shotgun, and 16 for a rifle requires a $200 tax stamp. It is nothing new. The government just wants your money.

It is not technically a 'permit' it is a $200 tax stamp. They are not hard to get, but the wait may be several months.

You don't even need a bill of sale, except for your own protection. You hand me the firearm, I hand you the cash, we go our separate ways, done deal. As long as it is not done across state lines. ie. You can't buy a firearm from your brother in Mississippi without it going through a FFL.

I suspect the poor guy bought an ar15 that the flash hider was not silver soldiered on and without it, the upper was not 16 inches.. There are tons of those out there and I also suspect they were looking to get him for something else and they settled on this.. I have never seen this as a primary charge...

i did a little reading, It looks like this SBR law only applies to shoulder stocked rifles?
So can i take a rifle or shotgun, cut the stock right at the finger grip area, cut the barrel to 15 inches and will be ok or not ok ?
