bank fishing injustice

Reply
Today I was fishing the Amite River, and a man who lives near it came up to me and told me that I was fishing on private property. It was clearly not private property. I don't have a boat, so i fish from the bank. It seems like there are less and less places for bank anglers like me to fish. If you have a boat you have easy access to many places, but it seems that everytime I find a good place to fish from the bank, there is some promblem with it like it is "private", etc. I think that this is a serious promblem for fishermen like me. Think about it guys, bank fishing is fishing at it's finest. No fancy boats with fancy engine, just you and your pole fishing from the bank. That is what fishing is and that is what fishing is all about. I think that this promblem needs to be addressed. What do all ya'll other fellers think about this issue.

Uncle Spanky loves muddy river water and skinny dippin . . .

Spank,
Correct me if I am wrong, but I think that all rivers are public waters and can't be posted. It is the property on the way to the river banks and the actual river banks that are/can be posted. Now come on and quit putting bs on the site, like that gator bs and the killer boat bs.

Luckly, for me I jus got a boat but spanky's right I use to do alot of bank fishin my self and I'd somtimes get that same crap hows the property private. As long as theres no disturbince going on wich u can't do too much of while fishin there shouldn't be a problem they should jus go do there own thing.

That is why you must fish in public places if you can't locate a good pond, lake or someone with waterfront property. If you get hurt on someone's property they can be sued and lose it all.

Uncle Cranky,
If You do Not Own The Land , Lease The Land Or Have Written
Permission W/ You That Says You Have The Owners Permission To Be On The Land.
YOU ARE TRESSPASSING ON PRIVATE PROPERTY !!!
You are very lucky that the person just asked you to leave.
There are alot of landowners that would have just called the sheriff and had you ticketed and removed or arrested.
Do Some research and find out who owns the land and ask permission b4 you go.
The worst that can happen then is you waste a little time and the landowner says no.

Hey Dude, you're a superstar!!! You'll make a great comedian or BSer. I was reading your post and the comments, Geaux Coastal had me digging for your previous post, and I couldn't stop laughing, man they're good, you must be the Cajun Leno.

Geaux_Coastal said it all if you get hurt then they can get sued. there is a law that was passed a couple of years ago stating that it doesnt matter whether or not there are posted signs no one can go on the property with out written permission. you can get a big fine or be put in jail. it is up to the property owners descretion. it is his/her land and they can do what ever they want. and as for being near a river or any body of water for that matter the land owner owns until the water starts.

I really don't mind if the cops throw me in jail because if I catch a MONSTER MUD CAT before they arrest me, then it's all worth it baby!!!

I don't consider all you guys who disagree with me real fishermen. You guys have your fancy boats, etc. Fishing in it's purest form is fishing from the bank. It takes a real fishermen to fish from the bank, and it takes more skill and patience to fish from the bank. You can take some rich pansy from Hollywood and put em in a boat and take em out and they can catch fish. But I guarantee they can't sit on a bank and fish the old fashioned way. That is real fishing. For all you guys who disagree with me, call yourselves fishermen all you want, but I disagree. REBEL16 is a real fishermen, just like me!

Trespassing is also a problem that should be addressed. If you were on public land of some sort, you should have made that clear to the person asking you to leave. That should have settled it. If we did not live in such a litigious society, private landowners would probably be more willing to allow people access to public waterways via private property.

first off spanky you call yourself a "real" fisherman and all you do is come on la sportsman and make jokes that dont even make since. then you ask us how to fish we tried to help you because you didnt sound like you had least bit of a clue how to fish and you gonna comment and tell us that we are not fishermen thats bull you dont deserve any of the help we gave you and as for you saying that rebel is a real fisherman (no offense rebel) if i read correctly he said that he just got a boat so if we are not fishermen bc we fish out of a boat then you are saying that rebel is not one either

Fish Stalker:

There are one of three things going on here:
1. He or she is stupid.

2. He or she just has nothing better to do and wants to get a rise out of people.

3. Both 1 and 2.

I suspect the latter because a stupid person probably wouldn't have the intellectual capacity to ask reasonable questions and then start insulting you after you have given him reasonable advice. I am sure Uncle Spanky is getting a kick out of it.

Right on Fish Stalker! My guess is that Spanky is out of school for the week because of the Easter Holiday. He probably is not old enough to drive, and too lazy to ride his bike to the public places that were handed to him on a silver platter. He also probably has too much time on his hands to do something constructive besides trying to trespass, and can only make up stupid posts on this site. He is too young to be sued and simply does not understand the consequences of such. Almost anyone can fish, the catching fish is a different story. At his young age he sure is FOS.

Sounds like a job for CCA. Call 'em up and get them to fight to make access free to all river banks.

Make a little $$ by taking your 5 gallon bucket you sit on,fill it with tanning budder, get a roller and chargeall the babes launching out of canal bank to oil them up before dey go boat riding. Soon- either 2- things may happen:!1) you can save enough $$$ to buy a boat and go where you want.2)you may be invited to go boat riding with the babes and fish with them. Destiny is in your hands.

Get youself a job and save up you money and buy you own place and you own boat. Go get you one of those small riverfront properties (without a house) on the Tickfaw for $190K/lot and with the leftover money you can buy you a brand new bass boat for about 40K. How many people are you gonna let trespass across your property and landscaping? How many times are you gonna pick up the trash they leave behind? How many times will you be drug into court due to injury, snakebite, stupidity and hope that the tresapasser doesn't get everything you worked for?

Good Ole Days!! This post, eventhough it is a stupid comment, reminds me of something.... When my dad was younger he was able to fish all the bar pits, ponds, rivers, etc. that he wanted. It may have not been legal but they could fish it. Now days you just get arrested or ticketed. He told me about some of the biggest bass he has ever caught in some of those lakes. Hell him and my uncles got caught fishing in some lake over by new roads and the cops took em back to the jail house and made em cook fish for the entire police station. That was their punishment lol. Anyway, my point was that he was able to experience things that my generation and generations after me will never be able to experience. and I really wish we could bc we will pass some awesome looking pit along a river or hwy and he would tell me about how him and his buddy fished that in high school until some rich prick bought the place and started running kids off of lake. Hell I would rather kids fishing in my lake instead of running around doing some of the things that they are doing now.... I know some of you older guys know what I am talking about.... (40+ years old) ....by the way.. I do have a boat and I dont trespass on other people's property lol

Many or most of the beaches along the Comite and Amite rivers are a part of the bed of the river and are held in trust by the government for use by the public. The beaches typically are below the annual highwater line and are part of the riverbed. You can access the riverbed anywhere a bridge crosses the river AS LONG AS it is legal to park alongside the road next to the bridge. Local municipalities can restrict parking along the highway if they choose to and in doing so they've denied you the right to access the river unless you get dropped off or ride a bike.

Warning: The local deputy dawg may not know this so you may still be cited or arrested for trespassing because he's likely to side w/ Joe Landowner. You may win in court, but at what cost?

Litigation is one reason that landowners work harder these days to keep people off of their riverside properties but the biggest reason, IMO, is litter.

Take your beer cans (and other litter) with you when you leave.
