NFL Thinks they own the phrase "Who Dat"

I just read where the NFL has sent Cease and Desist orders to several shops in Baton Rouge and New Orleans demanding they stop selling any apparel with "Who Dat" on it because the NFL owns the rights to the phrase. Since when?? I didn't realize the NFL owned any/all phrases that our fans come up with. This is stupid.

Is there a way for the shop owners to sue the NFL? How can they say they own it? If I remember correctly, the whole "Who Dat" thing started at Southern University...

it is stupid. But they dont own the phrase, what they want is for people to stop selling WHO DAT on saints merchandise because the saints logo IS nfl property, they are also claiming to own the fluer di lis logo, which goes back centuries in france.

"Who Dat"
"Who Dat" started in Patterson, La. when the Patterson High Lumberjacks went to the playoffs in 1979. It's been documented in an article in the Daily Review newspaper in Morgan City from 1979. There was a report on Fox 8 last week about it.

you notice the nfl never brought this up before! but now, that the who dats, won the nfc championship and is going to the superbowl, big, big, giant bucks! just another big greedy giant corporation, that wants everything for themselves and jack the little guy!!! ya, the shop owners can sue the nfl, if they want to try and spend countless millions trying!!! the nfl got so many lawyers on retainer sitting around, the little guy ain't got a chance!! bobby hebert coined the phrase WHO DAT NATION, maybe he should do the same thing!!

"who dat" dates back to the traveling minstrel shows of the late 1800's. I've been doing a bit of research on this. I'm sure a few N.O. atty's could get together and defend against the NFL on this.

Who Dat??? Gypsies, Tramps and Thieves---Breeze floats around like a Tiny dancer, Shockey tramples on defensive backs and all our secondary are highly noted thieves of the football!! And please don't forget that Tom Benson originally was making most of his money peddling snake oil at the Carnival!!

i don't know, what is going on with that, who dat stuff and the nfl, but seriously, i just don't trust benson!!! he has a lot of money, but i think, in his mind, he will never have enuf and will do whatever, he has to do, to make more, no matter who it hurts?? like moving the saints out of new orleans, again, after they win the superbowl!!!!! he has no loyalty to new orleans or louisiana, in his mine, its strictlty business, money, money, money!!! jack us, and all the saints fans, that never gave up on them, that made them what, they are today!! without the fans, the saints would have been history years ago!!

Funny how WHO DAT been around 20+ yrs and nothing from the NFL. Now all of a sudden de see Money MOney Money and now claim ownership, well I say screwDAT!!! Dey crazy!! I would try to sell 10x more WHO DAT!!! WHO DAT WHO DAT WHO DAT WHO DAT!! Sue me NFL!!!

Grocery bags
Why do you think they went to plastic grocery bags instead of the paper ones. The NFL claimed that they owned the bags for people to put on their heads at the games. Now the grocery stores can't use them anymore. You have to buy the officially licensed baags from the NFL. LOL

Dear Commissioner Goodell:

I was stunned to learn recently that the NFL is taking the position that it owns the exclusive trademark of the term "Who Dat" and has even threatened legal action against some mom-and-pop merchants selling t-shirts using the term. I would urge you to drop this obnoxious and legally unsustainable position and instead agree that "Who Dat" is in the public domain, giving no one exclusive trademark rights.

This letter will also serve as formal legal notice that I am having t-shirts printed that say "WHO DAT say we can't print Who Dat!" for widespread sale in commerce. Please either drop your present ridiculous position or sue me.

"Who Dat" was probably first heard in New Orleans minstrel shows well over 130 years ago. Much more recently, but before it was used in connection with the Saints, it was used as a rallying cry by St. Augustine High School in New Orleans. In the 1980s it was adopted by Saints fans in a completely spontaneous way. Only later did any legal persons, including the Saints and the NFL, try to claim it through registration.

Perhaps more significant than this history, "Who Dat" has become part of New Orleans and Louisiana popular culture. For the NFL to try to claim exclusive ownership of it would be like me registering and trying to claim exclusive ownership of the terms "lagniappe" and "laissez les bons temps rouler!”

Under Paul Tagliabue's leadership, the NFL was an unbelievable partner in helping us recover and rebuild after Hurricane Katrina. Thank you again. We look forward to your dropping your “Who Dat” position so that this partnership can continue without strain or blemish.

At today's press conference, Saints head coach Sean Payton addressed the recent controversy surrounding the phrase "Who Dat" by saying that he believes it belongs to the people.

plain and simple, this greedy corp., the nfl, just like every other greedy corp. in this country, just wants the money, no matter who they have to jack!!!! go vitter and why doesn't tom benson get into this, and tell the nfl where to get off and take up for the fans and louisiana??? oh, where is mary landrieu and mitch, who wants to be mayor of new orleans, and ray nagin and the rest of the louisiana politicians??? i don't guess, they realize it yet, if they get into the fight, almost guaranteed, to get re-elected!! when they do, they will jump in!!!!

...there is no such thing as true ownership anymore...they had one goverment once that if the living didn't pay property taxes on a cemetary plot...the politicans dug-up the dead ???...cheers
